Welcome to thaigold.com! These terms and conditions outline the rules and regulations for the use of our website and for purchasing products from our store.
By placing an order with us, we assume you accept these terms and conditions. Please do not place an order if you do not agree to all the terms and conditions stated on this page.
1. General Information
These terms and conditions apply to all users of the site, including without limitation users who are browsers, customers, and merchants.
By using this website and/or purchasing from us, you agree to be bound by these terms, including our privacy policy and any other policies available on the website.
We reserve the right to change these terms at any time. Any updates will be posted here, and your continued use of the website constitutes acceptance of those changes.
2. Payment Terms
All payments are processed securely through our payment gateway partners. We accept Zelle, Venmo, various cryptocurrencies, Wire/Ach Transfer, Wise, Paypal, and Card Payments.
You must provide accurate payment details at the time of purchase. If payment is declined, we are not obligated to fulfill the order.
Full payment must be made prior to shipping.
3. Order Process and Delivery
3.1 Order and Shipping Confirmation
Once an order is placed, you will receive an email confirmation. This email confirms that we have received your order, but it does not guarantee that we will be able to fulfill it. You will also receive a tracking number for your order once it's been shipped.
3.2 Shipping and Delivery
We ship worldwide, though we do no guarantee that we will be able to ship to any specific country. Shipping times may vary depending on your location. Estimated delivery dates will be provided at checkout.
We are not responsible for delays caused by shipping carriers, customs clearance processes, or any other unforeseen circumstances.
3.3 Risk of Loss
All items purchased are made pursuant to a shipment contract and are fully insured. In case of the shipment carrier's loss of package during transit or failure to deliver to the address provided by the customer (except for when the address provided by the customer renders the package undeliverable due to any circumstance such as incorrect address information), thaigold.com will be liable to issue a full refund or send a replacement piece pursuant to section 4.2, only if/when the carrier responsible for the shipment admits culpability.
4. Returns, Refunds, and Deposits
4.1 Return Policy
4.1.1 We are not obligated to accept returns and issue refunds, except for cases laid out in section 4.2.
Otherwise, we may offer anywhere from 10% below to 10% above the melt value of the gold jewelry, at our sole discretion. Except in cases enumerated in section 4.2, the customer is responsible for all shipping and insurance costs, and bears responsibility that the return reaches the address provided to him/her.
4.1.2 While we do our best to make highly stylized custom orders exactly to your liking and have full confidence in our ability and track record, we do not guarantee that a highly customized order such as an artistically designed pendant or ring will be to your satisfaction. For such orders, we are never obligated to accept returns or refunds.
4.1.3 Deposits paid in advance for custom orders are non-refundable, except in cases laid out in section 4.2. At our sole discretion, we may issue partial refunds of deposits.
4.1.4 For custom orders, we do our best to estimate the weight and price in advance, however it's not always possible to give an exact estimate in advance. When placing a custom order or requesting any sort of customization to an existing piece in stock, the customer agrees to pay whatever price we charge, which will be based on the exact weight of the piece when completed. Failure to pay shall result in forfeiture of deposit.
4.2 Cases for a Full Refund
The customer is entitled to a full refund / return / replacement / proportional compensation under the following circumstances:
- The piece provided is materially different than what was ordered, such as but not limited to cases where the piece is a different style, length, or has a different clasp than what was ordered. Such shall be at thaigold.com 's sole discretion. In such case, the customer shall return the piece to us for a full refund.
- The purity of the piece exceeds 5% less than promised (for example, a piece advertised as 96.5% pure gold tests less than 91.5% pure). Such must be verified by video of an xrf machine testing the piece at multiple various points (excluding the clasp and bail). In such case, the customer shall have the option of either returning the piece for a full refund, returning the piece for a replacement, or keeping the piece in exchange for proportional compensation for the difference in purity (such as receiving 10% of their money back if the piece tests as 10% less pure than advertised).
- The piece exceeds 0.3 grams heavier or lighter than advertised. In cases where the piece is lighter, the customer is entitled to proportional compensation based on the difference in weight. In cases where the piece exceeds 0.3 grams in weight, the customer is obligated to pay the difference in weight.
- The piece is not shipped to the customer within six weeks of making payment and placing the order. The customer shall be entitled to a full refund for all amounts paid for said order.
- The package was lost in transit or misdelivered by the shipping carrier, and the shipping carrier admits culpability. In such case, the customer shall be entitled to either a full refund or replacement.
In all the above scenarios in section 4.2, thaigold.com shall bear the costs for shipping and insurance and will either provide the shipping label for use or reimburse the customer for all associated costs.
4.3 Refund Process
Once your return is received and inspected, we will notify you of the approval or rejection of your refund. If approved, your refund will be processed within [number of days] to the original method of payment.
Return shipping costs are the responsibility of the customer unless the return is due to our error.
5. Intellectual Property
All content on this website, including text, images, logos, and product descriptions, is the property of thaigold.com and is protected by copyright and trademark laws. You may not use any content without written permission from us.
6. Limitation of Liability
We will not be liable for any damages arising from the use of this website or products purchased from our store, including but not limited to direct, indirect, incidental, or consequential damages.
Our liability is limited to the amount paid by you for the product(s) purchased.
7. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of California, and you submit to the exclusive jurisdiction of the courts in that location.
